PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Terms and Conditions

1. VAT
All of our quoted prices are inclusive of VAT at the prevailing rate, however adjustments will have to be made to comply with any change in rates or other legally imposed changes in respect of VAT.

2. Delivery
The delivery charge is £65 for delivery within the UK Mainland on most items with a few exceptions which are noted before payment is processed. Charges for deliveries outside the UK Mainland are available on request. Please note delivery may not be possible in more remote areas of mainland UK. If you believe your delivery address is outside of the UK Mainland then please contact us before you attempt to place an order. Our freight company will attempt to deliver your furniture within 21 days of recieving notification from us of delivery address etc, they will call the week before delivery is to be attempted to organise a delivery date , the freight company cover the country in areas if you wish to arrange a delivery date outside the dates given by the freight company this can be organised for an extra payment , please contact us to arrange this. the freight company operate a one man delivery , this is sufficient for the vast majority of deliveries however if you feel you require more people (due to a large piece of furniture or the customer not being able to lend a hand) please contact us and a two man delivery can be arranged for an extra fee.

3. We aim to deliver your furniture within the times quoted on our website when you place your order. Where multiple items have been ordered, we will endeavor to deliver them all together by the longest lead-time quoted, unless a split delivery is requested. This additional service will be subject to a further carriage charge. If the circumstances of your order change, we will contact you. If, however, it is delayed due to circumstances beyond our control, then we cannot accept any liability for consequential loss.

4. . Delivery dates
All delivery dates quoted at the time of your order are estimates. Whilst we make every effort to ensure that we honour estimated delivery dates, it is possible that circumstances beyond our control may cause delivery dates to be changed.

5. . Title
Ownership of goods shall remain with Qualityfurnishings of sussex and shall not pass to you until the agreed price together with all other sums due from you to Qualityfurnishings of sussex have been paid in full and goods have been delivered to your home, except in cases where goods are purchased on credit and the credit sales agreement specifies otherwise.

6. Storage
Unfortunately we do not have the facility to store your product for any length of time therefore if you cannot take the product within four weeks of us advising you of its availability, we will charge storage charges of £25 per week for a maximum of four weeks, after which we deem the order to be cancelled.

Where the product is a standard stocked line, the stock will be returned to free stock, which means that it will be made available to other customers. In this case we cannot guarantee immediate product availability when you are ready to take the order.

This will not apply where a product is available earlier than the lead time indicated or where you have specifically stipulated by a 'Not before by date' at the point of order, as printed on your order.

7. Disposal of old furniture
We cannot collect or dispose of your old furniture. However we ask that you do not dispose of your old sofa, table or bed if at all possible until delivery has been made as, in the unlikely event of a delivery problem arising, we cannot guarantee a loan piece of furniture.

8. Access

We will do our best to place the goods in the desired location however this cannot be guaranteed and the freight company is only required to deliver within your home , It is your responsibility to ensure that the product can be delivered into your home and . It is essential therefore that you discuss any possible restrictions on access into your home so that we can perform a risk assessment with you. You should think in particular about vehicle access, lifts and tight stairs etc. If windows or doors need to be removed in order for access to be gained it is your responsibility to arrange this at your cost and risk.

9. Colours and finishes
Photographs displayed on our website and display models and samples in our stores are representative of the finished product. Whilst every effort will be made to match all colours and finishes, goods are supplied on the understanding that there may be slight dye, shade and grain variations, particularly with natural products such as wood. Leather products are made from quality hides and may not be uniform in colour or texture and will show natural marks and scars. Where stated, some images have been digitally created to illustrate the colour options available for this range. These colours will be affected by your monitor and by your printer and therefore may not be 100% accurate to the finished product. Exact colour swatches can be seen in store.

10. Size and description of product
All sizes quoted are approximate. Size and product descriptions are given in good faith from our suppliers' information. Products are manufactured to perform within the appropriate industry measurement tolerances.

11. Variation in product specification
Due to the shortage of certain new raw materials, changes in legislation or safety requirements some products supplied by the Company may have minor technical alterations and could differ slightly in actual construction from the goods shown in sample or pattern form. The Company state any changes that are made will result in a performance of an equally high or improved standard. The quality coding will remain the same and the quality guarantee will continue to apply.

12. Guarantee
All goods supplied are guaranteed by the manufacturer for a period of 12 months from date of delivery in respect of faulty workmanship or materials. Your statutory rights are unaffected.

13. General care
The product(s) supplied are to be used for the purpose and in the manner for which they were designed. Most manufacturers include care and maintenance advice with their products, which should be read and followed. No responsibility will be accepted for damaged caused by cleaning if the care and maintenance instructions have not been followed.

14. Amending or cancelling your order WITHIN 7 days of placing your order (online only)

We promise to give you a full refund if you change your mind for any reason within 7 days of placing your order with us. After this date we will have in most cases a binding contract with our suppliers to supply or make your product. Any damaged goods must be reported within 7 days of the order being accepted and should be reported as such at the time of delivery for the query to be valid.

15. Cancelling your order AFTER 7 days of placing your order

Made to Order Products
Made to order products, have been produced specifically for you, therefore no refunds or exchanges can be made after 7 days of placing your order .if there is an error on our part regarding the product specification, or the item is found to be faulty the furniture will be remade to the specifications given and every attempt will be made to fullfill the contract undertaken with you and in agreement with the supply of goods and services act 1982 .

For non made to order products
For products ordered over the Internet, you have the right to cancel orders on products that are not made to order by notifying us in writing (including email) before delivery or within 7 working days of receiving of the goods.

If you cancel your order once it has been delivered, you must not use the goods, must take care of them, and must make them available to us when we call to collect them on the date we will agree with you. We will collect the goods and then refund the cost of the items ordered within 30 days of cancellation.

Please ensure that the goods are maintained in a saleable condition and in their original packaging.

If you do not comply with your obligations above, we will not agree to the refund or may make a reasonable charge to cover any costs that we incur (for example in respect of wasted collection journeys or goods that you have damaged or lost). Your statutory rights are not affected.

Exceptions to this policy
The Cancellation and Refund policy described above will stand unless:

·We have not followed your instructions clearly

·The order has been delayed by more than 5 weeks after the lead time quoted to you in writing at the point of order

·The product is found to be faulty

16. Cancellations by Qualityfurnishings of sussex
We reserve the right not to accept an order if:

We do not have the stock to fulfill the order
If we are unable to deliver the product to your area
If an item was incorrectly priced or described on the web site
If your payment was not authorised
If you have not complied with our terms and conditions of sale
If an order is cancelled by Qualityfurnishings of sussex, any payments made to us will be refunded within 30 days of the cancellation.

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
If you have any doubts about your statutory rights please contact your local Trading Standards department or Citizens Advice Bureau.

Amendments

We aim to constantly improve and develop the Quality furnishings of sussex website for the benefit of all our customers, to allow this process to take place, we may occasionally:

· modify or withdraw, temporarily or permanently, this Website (or any part of it) with or without notice; and/or

· change the Conditions from time to time, and your continued use of the Website (or any part of it) following such change will demonstrate your acceptance of such change.

· alter or extend promotions at any time.

If Quality furnishings of sussex is informed of any inaccuracies in the material on the Site we will attempt to correct them as soon as we reasonably can.

Damage to your computer

Qualityfurnishings of sussex makes every effort to ensure that this website is free from viruses or defects. However, due to the nature of the Internet, we cannot guarantee that your use of this website won’t affect your computer.

17. Unforeseen Circumstances

While every effort is made to meet our customers' demands, cancellations or variations may be necessary as a result of an Act of God, war, strike, lockout, labour dispute, fire, flood, drought, or other causes beyond our reasonable control.

18. Complaints and Remarks

If you have a complaint or a particular remark to make please do not hesitate to contact us immediately by telephone or e-mail, the details of which are contained under the "Contact Us" page.

Any complaint will be dealt with fairly, effectively and confidentially. Your statutory rights as a consumer are unaffected.

19. Contractual Capacity

In order to be eligible to enter into a contract with us to purchase goods through the website you must:-

provide the required information including your real name, payment details including your card address; your delivery address if different from your card address; e-mail address and telephone number;

be over the age of 18.

20. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected.

21. Law

These terms and conditions shall be governed by and construed in accordance with English law and you hereby agree to be subject to the jurisdiction of the Courts of England and Wales. All contracts are concluded in English.

We will only use the information that we collect about you lawfully and in accordance with the Data Protection Act 1998. These terms and conditions together with our current website prices, delivery details, contact details and Privacy Policy set out the whole of our agreement relating to the supply of goods to you by us.

nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us.

Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
